The latest news in Spain makes one thing very clear: smoking by hotel pools and on bar terraces is about to disappear under the new national anti‑tobacco reform currently moving through Congress.

The key change: smoking banned in all bar terraces and pools

Spain’s new anti‑tobacco law, approved by the Council of Ministers in July 2026 and now awaiting parliamentary approval, prohibits smoking and vaping in:

Bar and restaurant terraces

Hotel and community swimming pools

Beach areas, sports facilities, and public event venues

This is a major shift: terraces were previously the last “legal refuge” for smokers.

What counts as a terrace?

Under the new rules, any terrace—open, semi‑covered, or fully open—becomes a smoke‑free zone. Some regions already had stricter rules, but now the ban becomes national and uniform.

Protection of minors

The law also bans minors from consuming tobacco or vaping, with parents facing fines starting at €200 if a child is caught smoking.

Fines

Smokers: €300–€600 for smoking where prohibited.

Businesses (bars, hotels, restaurants): up to €600,000 for serious violations.

What this means for hotels and resorts

If you’re staying somewhere with a pool or outdoor bar:

Smoking will no longer be allowed around the pool area.

Terraces—whether for drinks, breakfast, or lounging—will be smoke‑free.
